Amended Bankruptcy Rules Impact Mortgage Servicers 

Effective December 1, 2025! 

The Federal Rules of Bankruptcy Procedure have been amended, introducing significant changes that directly affect mortgage servicers handling Chapter 13 bankruptcy cases. 

Key Changes to FRBP 3002.1 

New Motion Process for Mortgage Claim Status 

Debtors or case trustees now have an optional motion process to determine a mortgage claim’s status during a pending Chapter 13 case. This gives debtors an opportunity to cure any post-petition defaults that may have occurred. 

Enhanced HELOC Notice Requirements 

The rule now includes more detailed provisions about notice of payment changes for home-equity lines of credit. 

Three NEW Official Forms You Must Know 

Form 410C13-M1R – Response to [Trustee’s/Debtor’s] Motion Under Rule 3002.1(f)(1) to Determine the Status of the Mortgage Claim 

Use this form if you disagree with facts stated in the Trustee’s/Debtor’s Motion to Determine Status of Mortgage Claim.  

Critical: If you fail to respond or do not dispute the facts, the court may enter an order favorable to the moving party. 

Form 410C13-NR – Response to Trustee’s Notice of Disbursements Made 

You must use this form to respond to the Trustee’s Notice of Disbursements Made by providing the required information. 

Form 410C13-M2R – Response to [Trustee’s/Debtor’s] Motion Under Rule 3002.1(g)(4) to Determine Final Cure and Payment of the Mortgage Claim 

Use this form if you disagree with the facts set out in the Trustee’s/Debtor’s Motion to Determine Final Cure and Payment of Mortgage Claim. 

One Amended Official Form You Should Know 

Form 410S1 – Notice of Mortgage Payment Change 

The amended form adds a new section (Part 3) governing payment changes for HELOC loans. Changes to the form have been highlighted for your reference. 

ACTION REQUIRED 

Mortgage servicers should: 

  • Review and update internal procedures to accommodate these new forms and processes 
  • Train staff on the new motion process and response requirements 
  • Pay special attention to deadlines for responding to trustee/debtor motions 
  • Update HELOC payment change notice procedures to comply with the new Part 3 requirements
