Marc Pottak is a Partner at Kelley Kronenberg in the General Liability and Third-Party Insurance Defense Division, focusing his practice on general liability and third-party insurance defense, premises liability, New York Labor Law, construction law, professional liability defense, appellate matters, and coverage litigation. He is a tenacious advocate who keeps common sense in mind at all times. 

Prior to joining Kelley Kronenberg, Marc served as a partner and associate at a New York law firm, where he managed all phases of construction litigation including pleadings, discovery, motion practice, mediation, trial preparation, and appellate advocacy before the First and Second Departments. He developed extensive expertise in New York Labor Law sections 200, 240(1), and 241(6), addressing liability and risk transfer issues. He advised and collaborated with general contractors, owners, and subcontractors on various construction litigation matters, conducted rapid response on-site inspections utilizing his OSHA-30 certification, and developed resolution-focused strategies in coordination with investigators, medical experts, and workers’ compensation counsel. Marc also supervised and mentored junior attorneys, providing guidance on case strategy, drafting, and client management. Previously, he worked as an associate and law clerk at another firm, where he litigated insurance defense matters including construction defects, premises liability, construction accidents, and motor vehicle accidents. He managed the firm’s No-Fault defense team, successfully argued before the Appellate Division securing reversals of Supreme Court decisions, and represented clients in mediations and arbitrations. 

Marc earned dual Bachelor of Arts degrees in Philosophy and Anthropology from the State University of New York at New Paltz. He received his Juris Doctor from St. John’s University School of Law.
