Kelley Kronenberg Practice Partner Lindsey Stadnik secured final summary judgment for TypTap Insurance Company in a first-party property case filed in the 19th Judicial Circuit in St. Lucie County, Florida. 

The plaintiffs reported interior water damage from a water heater leak. TypTap completed its investigation and accepted coverage for the claim. However, the plaintiffs submitted competing repair proposals along with documentation for additional living expenses and contents damages, putting the value of the claim over $330,000.00. When TypTap did not make additional payments beyond its initial adjustment, the plaintiffs filed suit alleging breach of contract. 

Lindsey moved for summary judgment, arguing the plaintiffs failed to comply with the policy requirements for disputing the carrier’s adjustment. Under the policy terms and Florida Statute § 627.7011, the plaintiffs were required to submit a competing actual cash value estimate or proof of completed repairs to support any claim for additional payments. The plaintiffs never provided TypTap with either before filing suit. 

The Court granted the motion for final summary judgment, finding the plaintiffs failed to create a genuine dispute of material fact as to the amount of actual cash value damages. The plaintiffs will recover nothing.
