Kelley Kronenberg Team Resolves High-Exposure Catastrophic BI Case for Fraction of Potential Value
Kelley Kronenberg Partner Kelly Lynn Ferron, with crucial assistance from Nurse Paralegal Ana Guzman, swiftly resolved a Miami-Dade County catastrophic bodily injury case with highly unfavorable liability for a miniscule amount relative to the potential exposure.
The case initially appeared to be a routine soft tissue/minor injury matter received by the Team just a few months into Plaintiff’s treatment. However, Ana’s detailed and prompt review of incoming medical records revealed a pattern of quickly escalating diagnoses, treatment and referrals indicative of a far more serious spinal cord injury which would have inevitably led to a surgery recommendation and a significant increase in claimed specials. In addition, objective evidence of a TBI and resulting cognitive deficits was rapidly unfolding in real time.
Ana flagged her observations to the team, and the team moved quickly to aggressively push for resolution before the case snowballed any further. If it was not for Ana’s diligence, wealth of medical knowledge, and ability to promptly identify information integral to the development of defense strategy, the potential exposure would have easily exceeded policy limits in this matter.
While the details remain confidential, Ana provided Kelly with the information she needed to negotiate a highly favorable settlement for less than a fraction of the potential case value had it continued on the trajectory it was on. This outcome underscores the value of diligent medical record review and proactive, early and aggressive case management. Moreover, it highlights how skilled support staff are integral members of every team and can shape case outcomes.
