Kelley Kronenberg Partner Elizabeth Yohe and Practice Partner Nikoleta Barr secured dismissal of a claimant’s motion for attorney’s fees and costs in a workers’ compensation matter before Judge of Compensation Claims Wilbur W. Anderson in the Orlando District Office, on behalf of the Employer/Carrier, eliminating more than $50,000.00 in exposure. 

Claimant’s counsel filed a Verified Petition for Employer/Carrier-Paid Attorney’s Fees and Costs in connection with four petitions for benefits filed between October 2024 and September 2025, seeking authorization for shoulder surgery, temporary disability benefits, and continued psychiatric treatment. The Employer/Carrier disputed both entitlement to and the amount of fees sought. 

The Judge agreed that the fee entitlement and amount issues could not be resolved finding that the fees were inextricably intertwined with claims raised in subsequent petitions and dismissed the motion without prejudice. The ruling protected the Employer/Carrier from an immediate and unsupported fee award and preserved the right to contest any amended motion on the merits.
