Kelley Kronenberg Secures Attorneys’ Fees Settlement Following Appellate Victory in $1.5M Premises Liability Case
Kelley Kronenberg Partner and Business Unit Leader Paul Milberg and Associate Benjamin Lazarus have brought a $1.5 million premises liability case to a complete resolution, securing a settlement of their attorneys’ fees and costs award and an agreed dismissal with prejudice in the Circuit Court of the 6th Judicial Circuit in Pinellas County, before Judge Amy M. Williams.
The case arose from an alleged slip and fall in a stairwell at a condominium property. Paul and Benjamin secured summary judgment at the trial level after establishing that the plaintiff could not produce evidence of a dangerous condition or the association’s notice of any hazard. The plaintiff, represented by counsel from Morgan & Morgan, appealed to the Second District Court of Appeal. Paul argued before the appellate panel while Benjamin prepared the answer brief. The Court affirmed summary judgment in its entirety.
Following the appellate victory, the Court granted entitlement to attorneys’ fees at both the trial and appellate levels, supported by a proposal for settlement filed under Section 768.79. Prior to the trial court’s hearing on the amount of fees and costs, the parties reached a settlement agreement on the full award. The case was subsequently dismissed with prejudice, bringing the matter to a close.
The outcome eliminated the client’s $1.5 million exposure, produced fee recoveries at two levels of court, and resulted in a final resolution to the client and carrier’s satisfaction.
