Kelley Kronenberg Partner and Business Unit Leader Starr Linette Brookins and Attorney Sierra DeMartino, with key support from Legal Assistant Alissa Parks, secured a voluntary dismissal on behalf of our client in a negligence and products liability matter filed in the Circuit Court of the Third Judicial Circuit in Dixie County, with several hundred thousand dollars in potential exposure at stake. 

The plaintiff alleged that the client manufactured and/or sold a product that caused the plaintiff’s injuries. Through diligent discovery investigation, Starr and Sierra established that there was no proof the client had manufactured, sold, or supplied the product at issue. The team repeatedly sought dismissal on those grounds throughout the litigation. 

When opposing counsel declined to dismiss voluntarily, Starr and Sierra filed a motion for summary judgment to force the issue. Faced with that motion, opposing counsel agreed to voluntarily dismiss the matter before the hearing was held. Our client paid nothing, and the dismissal brought the matter to a close without the costs and uncertainty of further litigation.
