Successful Pursuit of 57.105 Motion Results in $68k+ Judgment

Kelley Kronenberg Partners, Alison Trejo, Todd Schwartz, and Jeffrey Wank secured a Final Judgment for Attorney’s Fees and Costs totaling $68,014.10. This accomplishment stems from the successful pursuit of a 57.105 Motion for Sanctions against Font & Nelson and the plaintiff. The Honorable Gregory M. Keyser, of Florida’s Fifteenth Judicial Circuit in and for Palm Beach County, presided over the proceedings.  

The case involved a non-weather roof leak claim initially reported and investigated by Tower Hill. Despite the specific nature of the claim, the plaintiff filed a lawsuit alleging damage from Hurricane Irma. Over the course of six different amended complaints, Font & Nelson pursued a two-count declaratory relief action seeking coverage for one of the reported “losses.” 

Significantly, the plaintiff dismissed this action on the eve of trial, leading to the Court granting our entitlement to fees and costs through the 57.105 motion. The result was a Final Judgment awarding our client $68,014.10.
